💢 EXPORT-IMPORT REGULATIONS ACT 💢

👈 ﻣﺎده 1: ﻣﻘﺮرات ﺻﺎدرات و واردات ﮐﺎﻻ و اﻧﺠﺎم ﺧﺪﻣﺎت ﻣﺮﺑﻮﻃﻪ ﻧﺴﺒﺖ ﺑﻪ ﮐﻠﯿﻪ واردﮐﻨﻨﺪﮔﺎن و ﻧﯿﺰ آﻧﻬﺎﯾﯽ ،ﺻﺎدرﮐﻨﻨﺪﮔﺎن ﮐﻪ ﺷﻤﻮل ﻗﺎﻧﻮن ﺑﺮ آﻧﻬﺎ ﻣﺴﺘﻠﺰم ذﮐﺮ ﻧﺎم اﺳﺖ ﺑﻤﻮﺟﺐ اﯾﻦ ﻗﺎﻧﻮن ﺗﻌﯿﯿﻦ و ﮐﻠﯿﻪ ﻗﻮاﻧﯿﻦ ﻣﻐﺎﯾﺮ ﺑﺎ آن ﻟﻐﻮ ﻣﯽ ﮔﺮدد .

👉 Article 1. Regulations in respect of the exportation and importation of goods and the delivery of related services to all exporters and importers and also to those that the application of the law requires their naming, shall be governed by this law, and all laws which are inconsistent with it, are hereby annulled.

👈 ﻣﺎده 2: ﮐﺎﻻﻫﺎي ﺻﺎدراﺗﯽ و وارداﺗﯽ ﺑﻪ ﺳﻪ ﮔﺮوه زﯾﺮ ﺗﻘﺴﯿﻢ ﺷﻮﻧﺪ :

👉 Article 2. Exportable and importable goods are classified into the following three categories: 1

💧 1- ﮐﺎﻻي ﻣﺠﺎز: کالایی اﺳﺖ ﮐﻪ ﺻﺪور ﯾﺎ ورود آن ﺑﺎ رﻋﺎﯾﺖ ﺿﻮاﺑﻂ ﻧﯿﺎز ﺑﻪ ﮐﺴﺐ ﻣﺠﻮز ﻧﺪارد.

💧1. Permissible goods: with the observance of the relevant criteria, the exportation or importation of these goods shall not require a license.

💧 2- ﮐﺎﻻي ﻣﺸﺮوط : ﮐﺎﻻﯾﯽ اﺳﺖ ﮐﻪ ﺻﺪور ﯾﺎ ورود آن ﺑﺎ ﮐﺴﺐ ﻣﺠﻮز اﻣﮑﺎن پذیر اﺳﺖ

💧2. Conditional goods: the exportation or importation of these goods is possible by obtaining a license.

💧 3- کالای ممنوع : ﮐﺎﻻﯾﯽ اﺳﺖ ﮐﻪ ﺻﺪور ﯾﺎ ورود آن ﺑﻪ ﻣﻮﺟﺐ ﺷﺮع ﻣﻘﺪس اﺳﻼم (ﺑﻪ اﻋﺘﺒﺎر ﺧﺮﯾﺪ و ﻓﺮوش ﯾﺎ مصرف) و ﯾﺎ ﺑﻤﻮﺟﺐ ﻗﺎﻧﻮن ﻣﻤﻨﻮع گردد.

💧3. Prohibited goods: the exportation or importation of these goods (purchase, sale or consumption) is forbidden under the sacred Islamic Shari'a and or by law.

💧 تبصره 1: دوﻟﺖ میﺗﻮاﻧﺪ ﺑﻨﺎ ﺑﻪ ﻣﻘﺘﻀﯿﺎت و ﺷﺮاﯾﻂ ﺧﺎص زﻣﺎﻧﯽ ﺑﺎ رﻋﺎﯾﺖ ﻗﻮاﻧﯿﻦ ﻣﺮﺑﻮﻃﻪ ﺻﺪور ﯾﺎ ورود ﺑﻌﻀﯽ از ﮐﺎﻻﻫﺎ را ﻣﻤﻨﻮع ﻧﻤﺎﯾﺪ.

💧 Note 1. The Government may, with the observance of the relevant laws and depending on the prevailing exigencies and circumstances, prohibit the exportation or importation of certain goods.

💧ﺗﺒﺼﺮه 2: ﻧﻮع و ﻣﺸﺨﺼﺎت ﮐﺎﻻﻫﺎي ﻫﺮ ﯾﮏ از ﻣﻮارد ﺳﻪ ﮔﺎﻧﻪ ﻓﻮق اﻟﺬﮐﺮ ﺑﺮاﺳﺎس آﯾﯿﻦ ﻧﺎﻣﻪ اي ﮐﻪ ﺗﻮﺳﻂ وزارت ﺑﺎزرﮔﺎﻧﯽ ﺗﻬﯿﻪ و ﺑﻪ ﺗﺼﻮﯾﺐ ﻫﯿﺄت وزﯾﺮان می رسد ﻣﻌﯿﻦ ﺧﻮاﻫﺪ شد.

💧 Note 2. The types and specifications of goods falling under any one of the aforesaid three categories shall be set forth by an ordinance to be drawn up by the Ministry of Commerce and approved by the Council of Ministers

👈 ماده 3: ﻣﺒﺎدرت ﺑﻪ اﻣﺮ ﺻﺎدرات و واردات ﮐﺎﻻ ﺑﻪ ﺻﻮرت ﺗﺠﺎري ﻣﺴﺘﻠﺰم داﺷﺘﻦ ﮐﺎرت ﺑﺎزرﮔﺎﻧﯽ اﺳﺖ ﮐﻪ ﺗﻮﺳﻂ اﺗﺎق ﺑﺎزرﮔﺎﻧﯽ و ﺻﻨﺎﯾﻊ و ﻣﻌﺎدن اﯾﺮان ﺻﺎدر و ﺑﻪ ﺗﺄﯾﯿﺪ وزارت ﺑﺎزرﮔﺎﻧﯽ ﻣﯽ رﺳﺪ .

👉 Article 3. Engaging in the business of exportation and importation of goods for commercial purposes, requires a commercial card which shall be issued by Iran Chamber of Commerce, Industries and Mines and approved by the Ministry of Commerce.

💧 تبصره - ﻣﻼك ﺗﺠﺎري بودن کالا و ﻧﯿﺰ ﻧﺤﻮه ﺻﺪور، تمدید و ابطال ﮐﺎرت ﺑﺎزرﮔﺎﻧﯽ ﻣﻄﺎﺑﻖ آﯾﯿﻦ ﻣﯽ ﻧﺎﻣﻪ اﺟﺮاﯾﯽ ﺧﻮاﻫﺪ ﺑﻮد ﮐﻪ ﺑﻪ ﺗﺼﻮﯾﺐ ﻫﯿﺄت وزﯾﺮان میرﺳﺪ .

💧 Note 1. The criterion of determining the commercial nature of goods, as well as the manner of issuing, extending and cancellation of the commercial card shall be in accordance with an ordinance approved by the Council of Ministers.

💧 تبصره 2: ﻣﺮﺟﻊ رﺳﯿﺪﮔﯽ و اﻇﻬﺎرﻧﻈﺮ ﻗﻄﻌﯽ ﻫﻨﮕﺎم ﺑﺮوز اﺧﺘﻼف ﺑﯿﻦ ﻣﺘﻘﺎﺿﯽ ﮐﺎرت و اﺗﺎق، وزارت ﺑﺎزرﮔﺎﻧﯽ ﻣﯽ ﺑﺎﺷﺪ .

💧 Note 2. Any dispute which may arise between the applicant of a commercial card and Iran Chamber of Commerce, Industries and Mines shall be referred to the Ministry of Commerce for consideration and final decision.

💧 تبصره 3: ﺷﺮﮐﺘﻬﺎي ﺗﻌﺎوﻧﯽ ﻣﺮزﻧﺸﯿﻦ، ﻣﻠﻮاﻧﺎن ﭘﯿﻠﻪ وران ،ﮐﺎرﮔﺮان اﯾﺮاﻧﯽ ﻣﻘﯿﻢ ﺧﺎرج از ﮐﺸﻮر داراي وزارت ﮐﺎرﻧﺎﻣﻪ ﺷﻐﻠﯽ از اﻣﻮر ﮐﺎر و اﺟﺘﻤﺎﻋﯽ (ﻣﺠﺎز) از داﺷﺘﻦ ﺑ ﮐﺎرت بازرﮔﺎﻧﯽ ﻣﻌﺎف ﻣﯽ ﺑﺎﺷﻨﺪ.

💧Note 3. Co-operatives of frontier zone inhabitants; Iranian mariners; hawkers; and workers residing abroad and holding employment records issued by the Ministry of Labour and Social Affairs, shall be exempted from obtaining commercial card.
